1. Data processing, personal data, purposes of processing, legal basis

We will process the personal data you have provided to us only in compliance with data protection, telecommunications and civil law provisions and for the following purposes:

To carry out and process the orders you have requested or the contract you have placed.

To carry out and process the booking you have made and to fulfil the obligations of a tourism business (registration law, local/tourist tax, etc.).

Only personal data that is necessary for the performance and processing of the services we owe (i.e. for the fulfilment of the contract) and/or for compliance with legal obligations, or that you have voluntarily provided to us, is collected and processed. Personal data is all data containing individual details about personal or factual circumstances, for example name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photos, account number, etc.

Providing your personal data is voluntary unless required by law or contract. Please note, however, that not providing it may result in disadvantages, such as bookings or orders not being able to be carried out, delayed processing, etc.

2. Data security

We have taken organisational and technical measures in accordance with the regulations to protect your data against unauthorised, unlawful or accidental access, processing, loss, use and manipulation. Despite our efforts to maintain a consistently high standard of due care, it cannot be ruled out that information you provide to us electronically may be viewed and used by other persons. Please note that we therefore accept no liability whatsoever for the disclosure of information due to errors in data transmission that are not attributable to us and/or unauthorised access by third parties (e.g. hacking of an email account or telephone, interception of faxes).

3. Transfer of personal data

For the purposes stated above, we will transfer your personal data to the following recipients

  • GASTROdat GmbH
  • Tourist board;
  • Municipal registration office;
  • Legal representatives, debt collection companies
  • Statistik Austria
  • Tax advisors, auditors
  • IT service providers we use

4. Storage period

We will not retain your personal data for longer than is necessary to fulfil (assert) our contractual or legal obligations (rights) and as permitted by applicable law. In any case, we store your personal data for as long as statutory retention obligations exist or limitation periods for potential legal claims have not yet expired.

5. Data processing when visiting our website www.bergpracht.at

Server log files, contact form (fault reports)

When you visit our website www.bergpracht.at, the website provider automatically collects and stores information in so-called server log files that your browser transmits to us – for the purpose of optimising the website with regard to system performance and user-friendliness, compiling usage statistics, and being able to detect, prevent and investigate any attacks on our website. This information consists of: your IP address, the name and version of your web browser, the website (URL) you visited before accessing this website, and the date and time of the page request on our website. Server log files are stored for 6 months. Longer storage only takes place if a legal obligation requires it and/or in order to investigate identified attacks on our website.

If you contact us via the contact form on the website or by email, the data you voluntarily provide (name, email address, telephone number, message text) will be stored by us for the purpose of processing your enquiry (e.g. fault report) and in case of any follow-up questions. The data entered in the contact form is therefore processed exclusively on the basis of your consent. You can withdraw this consent at any time; an informal email to us is sufficient. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal. The data and information that you voluntarily provide to us via the contact form on our website or by email will, unless you withdraw your consent earlier, generally be stored by us for 6 months. Longer storage only takes place if the processing of your enquiry requires it, a legal obligation requires it and/or in order to investigate identified attacks on our website.

Cookies are used on this website. A cookie is a small file that can be stored on your computer when you visit a website. Cookies are generally used to offer users additional functions on a website. They can be used, for example, to make navigation on a website easier, to allow you to continue using a website where you left off and/or to save your preferences and settings when you visit the website again. Cookies cannot access, read or change any other data on your computer.
